H.1800 An Act relative to improving access to emergency treatment plans

This bill seeks to improve the process of obtaining a guardianship order for incapacitated persons under Chapter 123 Section 8(b) and ensure that the Court ordered treatment plans are followed. The bill establishes the role of a treatment monitor to oversee the Court’s treatment plan and report on compliance with the plan. If the treatment monitor determines that the incapacitated person has not complied with the treatment order a hearing will be conducted to review the alleged noncompliance and conduct a review of the treatment plan. The bill will also allow the possibility of continued monitoring or treatment for incapacitated persons after their commitment order has ended (this is a new bill).
